Welcome to PieHost. These Terms and Conditions ("Terms") govern your use of our website and services. By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy.

Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you must not use our services.

1. Definitions

  • "Service" or "Services" refers to the web hosting and related services provided by PieHost.
  • "User," "You," or "Customer" refers to any individual or entity using our services.
  • "We," "Us," or "Our" refers to PieHost and its representatives.
  • "Account" refers to your hosting account with PieHost.
  • "Content" refers to any data, files, or information uploaded to our servers.

2. Account Registration

2.1. You must provide accurate, current, and complete information during registration.

2.2. You are responsible for maintaining the security of your account credentials.

2.3. You must be at least 18 years old to create an account.

2.4. You agree to notify us immediately of any unauthorized access to your account.

2.5. One person or entity may not maintain more than one account without prior authorization.

3. Acceptable Use Policy

The following activities are strictly prohibited:

3.1. Illegal Activities:

  • Any illegal activities or content
  • Pirated software, media, or content
  • Copyright or trademark infringement
  • Hacking, phishing, or fraudulent activities

3.2. Harmful Content:

  • Adult content or pornography
  • Violent, hateful, or discriminatory content
  • Malware, viruses, or harmful software
  • Content promoting illegal drugs or weapons

3.3. Resource Abuse:

  • Excessive CPU or bandwidth usage
  • Activities that degrade server performance
  • Running unoptimized or resource-intensive scripts
  • Cryptocurrency mining

3.4. Network Abuse:

  • Spamming or sending unsolicited emails
  • Port scanning or network probing
  • DDoS attacks or similar activities
  • Proxy or VPN services (without authorization)

4. Service Level Agreement (SLA)

4.1. We guarantee 99.9% uptime for our hosting services, excluding scheduled maintenance.

4.2. Scheduled maintenance will be announced at least 48 hours in advance.

4.3. Emergency maintenance may be performed without notice to ensure security and stability.

4.4. The SLA does not cover downtime caused by:

  • Issues with your website code or content
  • Third-party services or applications
  • DDoS attacks or similar incidents
  • Force majeure events

5. Payment Terms

5.1. All fees are due in advance for the selected billing cycle.

5.2. Payments must be made in Indian Rupees (INR) unless otherwise specified.

5.3. We accept credit cards, debit cards, and other payment methods as indicated on our website.

5.4. Prices are subject to change with 30 days notice for existing customers.

5.5. Failed payments may result in service suspension or termination.

5.6. You are responsible for all applicable taxes related to your services.

6. Renewals and Cancellations

6.1. Automatic Renewals:

  • Services renew automatically unless cancelled
  • You will receive renewal reminders via email
  • Renewal charges use your payment method on file

6.2. Cancellations:

  • Cancellations must be requested through your client area
  • Immediate cancellation terminates services at the end of current billing period
  • No refunds for partial months or unused services
  • Cancelled services cannot be reactivated after data deletion

7. Data and Backups

While we perform regular backups, you are responsible for maintaining your own backup copies of your data.

7.1. We are not responsible for data loss due to any circumstances.

7.2. Backups are provided as a courtesy and are not guaranteed.

7.3. Backup restoration may incur additional fees.

7.4. You should maintain independent backups of all critical data.

8. Suspension and Termination

8.1. We reserve the right to suspend or terminate services for:

  • Violation of these Terms or Acceptable Use Policy
  • Non-payment of fees
  • Illegal activities or harmful content
  • Excessive resource usage affecting server stability
  • Security threats or vulnerabilities

8.2. Suspended accounts may be terminated after 7 days without payment or resolution.

8.3. Upon termination, all data will be deleted and cannot be recovered.

8.4. No refunds will be provided for terminated accounts due to policy violations.

9. Limitation of Liability

9.1. Our liability is limited to the amount paid for services in the past 12 months.

9.2. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data, profits, or business opportunities
  • Service interruptions beyond our control
  • Actions of third parties
  • Your website content or activities

9.3. Services are provided "as is" without warranties of any kind.

9.4. You indemnify us against claims arising from your use of our services.

10. Modifications to Terms

10.1. We reserve the right to modify these Terms at any time.

10.2. Material changes will be notified via email or account notification.

10.3. Continued use of services after changes constitutes acceptance of new Terms.

11. Dispute Resolution

11.1. Any disputes shall be resolved through good faith negotiations first.

11.2. If negotiations fail, disputes shall be subject to binding arbitration.

11.3. These Terms are governed by the laws of India.

11.4. Courts in Haryana, India shall have exclusive jurisdiction.
